The use of the “www.inserail.es” website and its service by internet users are governed by the terms and conditions set out in this notice.

The only purpose of these links is to provide the User with possibility of complementing the information obtained in the website. INSE RAIL, S.A. cannot be held responsible for the results derived by the User from accessing such links.

EXCLUSION OF WARRANTIES AND LIABILITY:

INSE RAIL, S.A. does not warrant and can not be held responsible for damage of any kind arising from:

• The non-availability, non-maintenance, non-function or malfunction of the website’s services and/or contents.
• The lack of suitability or validity of the website’s services and/or contents to satisfy the Users’ requirements or expectations.
• The presence of viruses or programes with malicious or damaging content.
• The reception, storage, broadcasting or transmission of the contents by the Users.
• Unlawful, negligent or fraudulent use of the website, its services and contents by the Users; use in breach of the stated terms and conditions, use in bad faith and contrary to generally accepted usage.
• Illegality and lack of quality, reliability, usefulness and availability of the third party services provided to the Users through the website.
• The breach of any obligations and commitments in relation to the services provided to the Users through the website by third parties.

DURATION:

The duration of the website service and the services provided is indefinite.

Without prejudice to the above, INSE RAIL, S.A. reserves the right to interrupt, suspend or terminate the website service or any services that are provided through it under the same terms shown in the third condition above.

INTELLECTUAL PROPERTY:

If a User or third party considers that there has been a violation of intellectual property rights due to the inclusion of certain content on the website, they should notify this to INSE RAIL, S.A. indicating:

• The Personal data of the apparent owner of these rights. If the claim is presented by a third party, such representation must be clarified.
• The contents which are alleged to breach intellectual property rights and their location on the website.
• Proof or verification of the intellectual property rights.
• A specific statement in which the concerned person attests the veracity of the information given in the notification.

The legitimacy of the intellectual or industrial property rights of contents supplied by third parties is the responsibility exclusively of those third parties.

LEGAL JURISDICTION:

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Spain

INSE RAIL, S.A. and the User, renouncing any other jurisdiction, are subject to the procedures according to the Law 60/2003, of 23rd December, for any and all disputes which may arise out of the provision of the website service, its services and contents and out of the interpretation, application, fulfillment or breaching of this legal notice.
